Election Ballot Clarification

We want to provide full transparency regarding the recent update to the election ballot and the rationale behind our decision to correct the initial oversight.

A homeowner submitted their nomination form via email ≤10 minutes before the official deadline. While the submission was received on time, it was inadvertently missed during the ballot preparation process due to an assistant being out the following day. As soon as the omission was brought to our attention, we reviewed the timestamped email and confirmed it was submitted before the deadline.

In accordance with Texas Property Code §209.00593, and to remain compliant with our governing documents and fair election procedures, all candidates who submit timely nominations must be included on the ballot. Failing to do so could compromise the integrity of the election and potentially subject the Association to legal challenges.

We understand this correction caused concern among residents, but we were legally and ethically obligated to take immediate corrective action. By updating and reissuing the ballot, we ensured the election remains valid and all members are properly represented.

If any residents previously experienced technical issues accessing the online ballot, the issue should now be corrected.

We are reviewing our internal procedures to ensure better safeguards are in place moving forward and sincerely appreciate your understanding as we uphold the HOA’s legal and fiduciary responsibilities.
