Violation Notices & Fair Enforcement Process

We understand that some homeowners have concerns regarding the number of violation notices issued within the community. Our goal is to clarify the inspection and enforcement process to ensure transparency and demonstrate that all homeowners are treated fairly, consistently, and in full compliance with HOA policies and Texas law.

Routine & Unbiased Community Inspections

Frisco Preston Hills HOA is a deed-restricted community, which means all residents agree to abide by the Covenants, Conditions, and Restrictions (CC&Rs) and community standards. To ensure compliance, the HOA conducts inspections every two weeks. During these inspections:

All homes are inspected using a standardized checklist based on the CC&Rs.

Inspectors do not have access to homeowner names—only property addresses—ensuring no bias in enforcement.

Violations are issued consistently across all homes, regardless of the owner’s status, history, or position within the community.

Even resident board members can receive violations without the inspector knowing their identity.

This blind inspection process ensures that no one is unfairly targeted, and all properties are held to the same standard.

Violation Notices Are a Standard Compliance Process, Not Harassment

We understand that receiving a violation notice can be frustrating, but it is important to emphasize that this process is not personal or punitive—it is simply a routine enforcement measure required by HOA governing documents and Texas law.

The HOA is legally required under Texas Property Code Section 209.006 to issue violation notices by mail to the property owner’s registered mailing address.

Notices provide homeowners with an opportunity to correct the issue before further action is taken.

Enforcement applies uniformly to all homeowners—there is no selective targeting or personal bias involved.

Harassment involves intentional, repeated targeting of an individual, which is not how the compliance process operates. The HOA does not single out any homeowner; rather, our goal is not to penalize homeowners, but rather to maintain the aesthetic and property values of the community while ensuring a consistent and fair application of the HOA’s rules.
